Northern Ireland abortion rights challenge to be heard by Supreme Court

DATE: 28 Jul 2017

The Supreme Court is to hear the Northern Ireland Human Rights Commission's challenge to the legality of the law on abortion in Northern Ireland. The Northern Irish High Court allowed the Commission's challenge, but an appeal to the Court of Appeal in Northern Ireland by the Ministry of Justice and the Attorney General was allowed. The Court of Appeal granted permission to appeal to the Supreme Court and the challenge has been expedited to be heard on 24-26 October 2017.

The case challenges the failure of the existing law to allow abortion in cases of rape, incest and serious foetal abnormality. It alleges breaches of Articles 3, 8 and 14 (read with Article 8) of the European Convention on Human Rights.

David Blundell is instructed as junior counsel to the Northern Ireland Human Rights Commission.
