Inquiry into a proposed high density residential scheme comprising up to 458 dwellings plus associated infrastructure on a 5.4ha site near Dunstable town centre currently used as a trading estate.
The main issues before the inquiry were: (1) whether residential development on the appeal site was acceptable in principle, notwithstanding that the site was reserved for employment uses under the Local Plan; (2) whether the proposed development would have an unacceptable impact on neighbouring properties and/or would constitute overdevelopment of the site.
Christopher Lockhart-Mummery QC and Charles Banner appeared for the appellants, Lionsgate Properties.
On 4th December 2007, the Secretary of State allowed the appeal and granted planning permission in accordance with the Inspector's recommendation.
