Wandsworth BC v Clearchannel UK Ltd (Divisional Court) [2007] EWHC 1079 (Admin)

This was an appeal by way of case stated to the Divisional   Court from the decision of the South Western Magistrates Court on behalf of Wandsworth Borough Council. Guy Williams successfully represented the Council and the decision of the district judge was quashed.

 

The case concerned the control of the display of advertisements and in particular the operation of deemed consent under Class 13 of Town and Country Planning (Control of Advertisements) Regulations 1992 (SI1992/666) ("the 1992 Regulations") where an advertisement has been displayed on the site since 1974.

 

The Council successfully argued that the district judge had misapplied the law. Cases considered:
