An appeal by way of case stated by the District Council against the decision of a magistrates’ court to acquit a defendant of a charge of contravening an abatement notice. The case considered the nature of the defence of best practicable means and its application by way of defence to an alleged noise nuisance. Matthew Reed acted for the District Council.
