An enforcement notice against a gypsy site consisting of several pitches was upheld on appeal. The period for compliance expired in November 2005, shortly before the publication of C1/2006. The gypsies then made further applications for planning permission. These were refused and the gypsies appealed. Before the hearing of the appeal the local planning authority sought an injunction to require the gypsies to leave the site. Plender J considered the guidance in paragraph 100 of South Bucks DC v Porter and felt able to conclude that the gypsies now had a real prospect of obtaining at least a temporary planning permission. He therefore refused to grant an injunction.
