DATE: 29 Jul 2009
An agreement to consent to a divorce in return for a life interest in a property had not on the evidence conferred exclusive possession on the former wife, but she had relied on the promise of a life interest and, in forgoing the certainty of a court order for ancillary relief, she had suffered a substantial detriment so that the former husband would be estopped from denying the promise.
Myriam Stacey acted for the second defendant.
