Several ongoing HRA damages cases, all in the mental health or community care field. One such case, against a local authority which is in the process of settling the claim, is brought in reliance on Articles 5 and 8 ECHR and concerns a vulnerable young disabled man who was effectively imprisoned (as per the conclusion of an independent investigatory report) in the care home in which he resided for a period of almost three years.
