A complicated application in a dilapidation case based on a mediation covenant. D3 & D4 sought to rely upon clause said mediation covenant to dismiss court based dilaps claim. Detailed analysis of leases (head lease, sub lease, underlease and concurrent lease) suggested D may not in fact be liable under lease, but we obtained an order binding them on admission. Solicitor was present during hearing. This is an important case because the relationship between the various tenants was complex, and the application by D was misconceived.
