On a 2 day trial before His Honour Judge Purle QC (sitting as a High Court judge), the issue was whether an occupier of a residential property had an equitable interest with priority to an HSBC mortgage (being an interest that was an overriding interest that had not been overreached on the creation of the mortgage).
