Chichester DC v Secretary of State [2006] EWHC 1876 Admin, [2007] JPL 389

DATE: 28 Jul 2007

A developer constructed a building which he said was an agricultural store/workshop but which the local planning authority said was tantamount to a house.  On an enforcement notice appeal an Inspector granted planning permission subject to a condition requiring that the building only be used for agricultural purposes.  It was, however, not apparent that he disagreed with the Council's assessment of the building and the decision was quashed.

On a redetermination the enforcement notice was upheld.

Richard Langham appeared for the local planning authority.
