In Birmingham City Council v Walker [2007] UKHL 22; Times, May 17 2007, the House of Lords considered the effect of the definition of "successor" on events which occurred prior to the creation of secure tenancies. The House held that a person was not to be treated as a successor by virtue of section 88(1)(b) of the Housing Act 1985 where she had been a joint tenant but had become a sole tenant of a property prior to her tenancy becoming secure.
