Katharine has undertaken a wide variety of cases involving all different forms of nuisance, which have become a particular speciality of her practice. These have ranged from flooding, subsidence, noise nuisances, dangerous buildings, mines, quarries, Rylands v Fletcher situations to coastal and river protection. She also has experience in conducting group litigation nuisance claims in the environmental context.
Katharine recently appeared in the important Court of Appeal case of Birmingham Development co Ltd v Tyler [2008] EWCA Civ 859, in which the Court of Appeal had to consider the undecided issue of when a person’s fear of danger, arising from the condition of adjacent land, could constitute a nuisance.
Katharine also has expertise in environmentally related disputes in connection with protest demonstrations. Katharine has developed a particular specialisation in obtaining urgent injunctions in such situations. Having acted in Hampshire Waste v Persons Unknown, in which Katharine obtained the first injunction to be granted against “persons unknown” in the context of trespass and protest demonstrations, she has frequently been involved in obtaining injunctions in situations of high profile protests. These have involved disputes concerning power stations, the energy industries and the protection of birds and wildlife.
