David Holland is primarily a property practitioner. However over recent years he, along with other members of the Landmark Property Team, has developed an expertise in obtaining injunctive relief to prevent trespass on property even though the claimants might not be able to specify the identity of those who might attempt to trespass.
This is particularly applicable to the environmental field where for example he recently acted on behalf of power generation Company E.On and the National Grid in obtaining an injunction preventing trespass against “persons unknown” when as part of a proposed “day of mass action” on 9th August 2008 an attempt was to be made to shut down the power station with threats of incursions by land, sea and air. David successfully obtained an injunction which covered not only the area of the main power station but the airspace above it and an “exclusion zone” of 25 meters surrounding the cooling water intake on the River Medway. Further special directions were given to permit the order(s) to be served by positioning them in prominent places around the site and by e-mail.
The use of this civil remedy was successful in marked contrast to the very recent failure of the criminal prosecution brought by the CPS against the protesters who had gained entry on an earlier occasion in October 2007 and scaled the chimney at the power station.
In addition David is highly experienced in all aspects of nuisance affecting property in the environmental field arising from for example flooding, pollution, subsidence etc.
