R (Pridmore) v Salisbury District Council -(November 2004) (2005) 1 P&CR 32 (Newman J)

Article 6 of the Order required notice of any application for planning permission to be served on a person who, 21 days before the date of the application, was the owner of land included in the application. The consequences of non-fulfilment were that the application should not be entertained or determined by the local planning authority. The applicant for planning permission had failed to notify the claimant as required by art.6 of the General Development (Procedure) Order. The local authority had erred in law in treating the original application as valid and should have required the developer to make a fresh application. Daniel Kolinsky acted for the claimant.
