HOTT V ABP [2012] EWCA Civ

Court of Appeal dismisses appeal from the judgment of Vos J. It holds, affirming the principle in BWB v Westminster, that in assessing a landlord’s “intention” under section 30(1) (f) or (g) of the Landlord and Tenant Act 1954, there is no “circularity” in assuming that the landlord has regained possession.
