Katherine is instructed by the Secretary of State in an appeal brought in the Care Standards Tribunal under section 166 of the Education Act 2002. The Appellant school appeals against the decision of the Secretary of State for Children, Schools and Families to close down the school following unfavourable Ofsted reports.

This is only the second such appeal thus far and is a developing area of jurisprudence.
