Brendan Murphy v the Ethical Standards Officer of the Standards Board for England

DATE: 28 Oct 2004

In one of the first appeals to be heard from a decision of the Case Tribunal of the Standards Board for England’s Adjudication Panel the High Court considered the compatibility with Article 6 of aspects of the Case Tribunal procedure and further found that the effect of the requirements of the local government Code of Conduct was compatible with Article 10 of the European Convention. The court also endorsed the Standards Board’s interpretation of the meaning of a personal and prejudicial interest within the Code.

Katherine Olley represented the Ethical Standards Officer.
