David’s environmental practice covers: (1) statutory challenges and judicial reviews for and against decision makers; (2) advisory work for industry, major nature conservation charities and government departments; (3) public inquiries on detailed technical environmental issues arising in respect of the Birds, Habitats, EIA and SEA Directives, flooding and the water environment, contaminated land; and (4) acting as legal assessor and Secretary of State decision maker in various contexts.

His recent and pending judicial review work includes acting: (1) for a county council in a challenge under the SEA directive to the East of England Plan; (2) for a Council in defending a challenge under the EIA directive to a major windfarm consent and for a developer in defending an EIA challenge to a major industrial development; (3) acting for residents in proposed judicial review of landfill extension consent raising

His recent judicial reviews include: R(Dinedor Hill Action Group) v. Herefordshire County Council [2008] EWHC 1741 Admin - for Friends of the Earth in challenge to housing allocation;  R(Finn – Kelsey) v. Milton Keynes Borough Council [2008] EWHC Admin - for the Council defending grant of permission for major windfarm development;  R(Littlewood) v. Bassetlaw [CO/1465/2008] for developer in defence of challenge to large industrial development. He is acting for Hertfordshire County Council in its challenge to the East of England Plan and for a group of local residents in respect of a possible challenge to the grant of consent for extensions to a major landfill site in Sussex.

Other Environmental Work

David assists leading nature conservation organisations in making: (1) representations on changes in UK policy; (2) complaints to Europe in respect of infringements of EU law; and (3) objections to particular applications. He acts as a Secretary of State decision maker in certain environmental law appeals. His work for the commercial sector includes advising and representing in cases relating to contaminated land liabilities and “clean up” proposals; advising on the land use planning implications of flooding and major hazard installations; and he represents individuals and local amenity groups on issues relating to enforcement of environmental controls at amongst other landfill, windfarm and major hazard sites.
